Gag Order Denied in Oracle, SAP Trial

Bad news for SAP, Hewlett-Packard, it’s new CEO Léo Apotheker and anyone else tarred and feathered in Oracle CEO Larry Ellison’s recent fusillade of anti-SAP broadsides. A federal judge has denied a request for a gag order in the increasingly contentious legal battle between Oracle and SAP.

According to a court filing made public this morning (click on image above to enlarge), U.S. District Judge Phyllis Hamilton denied Oracle’s request for a three-day delay in the trial and ordered it to begin as scheduled on Monday, without the additional restrictions on extrajudicial communication SAP had requested.

Nonetheless, SAP–which, in a change of strategy, will not contest Oracle’s allegations that it contributed to acts of copyright infringement committed by its discontinued TomorrowNow unit–pronounced itself satisfied, saying in a statement, “The decision to narrow the scope of the trial and to start the trial on time will keep the focus on the core issues and eliminate the unnecessary sideshow. This will increase the chance of a faster resolution and we couldn’t be more pleased.”

So expect jury selection to occur on Monday, opening arguments on Tuesday and the rhetorical jousting we’ve seen to date to continue.

Another Wiif for Nintendo

Nintendo warned last month that its first-half results would be lousy, and this morning the company delivered on that promise, posting its first half-year loss in seven years.

For the six months to September 30, the Japanese gaming giant reported a $24.7 million loss as sales of hardware and software slipped. Nintendo sold 6.69 million DS units during the half, down significantly from the 11.7 million it sold during the same period last year. And it sold fewer Wiis as well–4.97 million, down from the 5.75 million it shipped last year. On the software side, things were equally dismal. DS software sales declined to 54.84 million units from 71.15 million units in 2009; Wii software sales fell to 65.21 million units from 76.21 million units in the same period a year earlier.

The beginnings of an ugly trend for Nintendo, which is fast losing momentum in a motion-enhanced gaming market in which its rivals are gaining it. With Sony’s PlayStation Move motion controller already at market and Microsoft’s Kinect for XBox 360 (Project Natal) headed there next month, it is becoming increasingly clear that the Wii–now about four years old–needs a full-on refresh.

Downgrade PSP to version1.5 using PSP battery

Lots of users downgrade their PSP to version 1.5 because they can upgrade their PSP to any version from 1.5. And if you upgrade your PSP to version 3.51, you can play any downloaded games and run any applications. Do you know that you can downgrade your PSP system to version 1.5 all by yourself by turning your PSP battery into a pandora's battery? All you need are an original PSP battery (with more than 50% charge) and a Memory Stick Pro Duo with 1GB memory or above.

I. Get ready (Reformat PSP memory stick)
Before you get started with the downgrade, you need to reformat your PSP memory stick. If you don't know how to reformat it, you can refer to the steps below:
1. Press the HOME button on the bottom left of your PSP.
2. Use the arrow keys to move to the Settings area, then move the up and down keys to go to System Settings.
3. Push the "X" button (or the "O" button, depending on which button is the "Enter" button of your PSP) and scroll to find the "Format Memory Stick" option. Push the "X" button again to select this option.
4. Your PSP will now confirm that you want to reformat the memory stick, choose yes and your PSP will be physically formatted in a few seconds.
To do the downgrade, you also need to download an application pack. After the downloading is finished, what you get will be a compressed application pack named "pandora", decompress it to the root directory of a hard disc, say Disc H. In this "pandora" folder, you can see four folders including mspformat, msinst, battery and installer, and a file named UPDATE.PBP.
Now you are ALL ready to turn your PSP battery to a Pandora's battery and use it to downgrade any PSP!
II.Turn your PSP battery into a padora's battery
Step 1: Logically reformat your PSP Connect your PSP to your computer. And your PSP will be recognized as a new hard disc, say K. Then click Start -> Run, input cmd in the popped up dialog box, and click OK to enter DOS system. Use the below commands one by one to run the mspformat file: Input "H:", and press the "Enter" Key on your keyboard. (Here H is the disc where the "panndora" folder is located) Input "cd pandora" and press the "Enter" Key on your keyboard. Input "cd mspformat" and press the "Enter" Key on your keyboard. Then input "mspformat.exe K" and press the "Enter" Key on your keyboard. (Here K is the name of the disc that your PSP is recognized on your computer.) After these commands, your PSP will be logically reformatted in a minute.

Step 2: Open the recognized PSP hard disc on your computer, create a new folder and name it "PSP", open this "PSP" folder, create a new folder and name it "game". Copy and paste the "installer" folder and the "battery" folder into the "game" folder. Then copy and paste the UPDATE.PBP file to the root directory of the PSP hard disc on your computer.
Step 3: On your PSP, switch to the Game option, press X or O (depending on which is the "Enter" key of your PSP). Go to "installer" and press X or O to run it.

In a few seconds, a file named "msipl.bin" will be created on the root directory of your PSP memory disc. And now, you should take out your memory disc and then put it back in, which seems to be useless but is a very necessary step.
Step 4: Connect to your PSP back to your computer. Then enter DOS system as mentioned in Step 1. Use the below commands one by one to run the mspformat file:
Input "H:", and press the "Enter" Key on your keyboard
Input "cd pandora" and press the "Enter" Key on your keyboard.
Input "cd minst" and press the "Enter" Key on your keyboard.
Then input "msinst.exe K K:\msipl.bin " and press the "Enter" Key on your keyboard. (Here K is the name of the disc that your PSP is recognized on your computer.)
When you see a popped up message asking if you are sure, click "Yes".
Step 5: Go back to your PSP, switch to the Game option, press X or O (depending on which is the "Enter" key of your PSP). Go to "battery" and press X or O to run it, press X or O to OK every popped up message to finish running the battery application.

Now, your pandora's battery has been created!

III. Use the created pandora's battery to downgrade your PSP
After you turn your batter to a PSP downgrade battery (pandora's battery), you can use it to downgrade your PSP by following the instructions below:
Take out your PSP Memory Stick and battery, then put back in your PSP Memory Stick first, and put your battery back in.Turn your PSP power on, when you see three options; select the Downgrade option, your PSP will be downgraded in a very short time and it will be automatically shut down afterwards.Turn your PSP on again, and you will see a blue screen. But no worries, you can just press the O key, and your PSP system is already version 1.5!
Note: The above process will turn your PSP battery to a pandora's battery that can be used for PSP downgrade. But the pandora's battery cannot be used to play PSP games, videos or music. And the process is not reversible. You will need to get an additional PSP battery for regular uses. However, you can use your pandora's battery to downgrade any PSP to version 1.5 or even repair you PSP.

1. Make sure your video is the one you want to upload, then click the share button in the menu bar.

No BlackBerry Blackout in UAE

Research in Motion’s BlackBerry service won’t be going dark in The United Arab Emirates on Monday. This morning the the UAE’s Telecommunications Regulatory Authority (TRA), which had threatened to ban the service over security concerns, backed off that threat after reaching some sort of deal with RIM. “[The TRA] has confirmed that Blackberry services are now compliant with the UAE’s telecommunications regulatory framework,” the agency said in a statement.

Just how, exactly, RIM (RIMM) reached compliance isn’t exactly clear. The company refuses to discuss its deal with the UAE, claiming its terms are confidential. But according to the TRA, it’s the result of “positive engagement and collaboration” with the company, so my guess is it got what it wanted: An arrangement that will give it access to BlackBerry data.

Meanwhile, RIM’s services will continue uninterrupted as it prepares for the UAE launch of the Torch and Curve model in the weeks ahead.

Exclusive: New MSNBC.com-BermanBraun Online Political Site BLTWY Launches

While it seems to be a stealth launch, the new online political site for MSNBC.com, created by Hollywood production firm BermanBraun, is now up and running.

Called BLTWY–as in “Beltway,” presumably for the road that rings the nation’s capital–the striking rich-media content site is now live. (You can see it above.)

BLTWY seems to follow along the sweeping horizontal wall and extensive use of larger photos and videos that characterize BermanBraun’s popular Wonderwall celebrity site.

In May, BermanBraun and MSNBC announced the collaboration in a blog post, noting:

HP’s Own CEO Candidates Unlikely to Seek Freedom After Passover

Hewlett-Packard’s decision to name Léo Apotheker as its new CEO hasn’t gone over particularly well with investors, who dragged the company’s stock into the mud this morning. At $40.50, HP shares are down 3.76 percent as I write this. So how is it going over internally, particularly with those execs who’d been internal candidates for the job?

This is, after all, the third consecutive time that HP has gone outside to pick a leader, previously hiring Carly Fiorina from Lucent and Mark Hurd from NCR (NCR). And before deciding on Apotheker, the company was known to be considering three CEO-caliber candidates from its own roster–Todd Bradley, executive VP of HP’s personal systems group; Ann Livermore, vice president of HP’s $54 billion Enterprise Business; and Dave Donatelli, executive VP of Enterprise Servers and the guy who helped lead HP’s successful bidding war for 3Par. Donatelli is a relatively new hire and may not have had strong CEO aspirations (yet), but Livermore has been passed over the the top job three times now, and sources at HP say Bradley had been “hopeful” about becoming the company’s next CEO.

Has Apotheker’s appointment made these three execs flight risks?

J.P. Morgan analyst Mark Moskowitz doesn’t think so. “Livermore has been an HP-lifer and credited with integrating the enterprise services and hardware practices,” he wrote in a note to clients today. “We think [she] will want to stick around as the enterprise solutions mantra continues. Meanwhile, Bradley has been instrumental in augmenting the personal systems business, and we think he will be focused on next leveraging the Palm acquisition into a potential disruptive force in mobile communications environments. Lastly, Dave Donatelli is still relatively new to HP, and we expect him to be busy integrating the 3Par and 3Com assets, both deals of which he was the chief architect, based on our conversations with industry contacts.”

Makes sense, right? Livermore is a veteran and her hopes for the CEO spot couldn’t have been too high after being passed over for it twice. Donatelli has been at the company only a little over a year, reports to Livermore and is still making his mark at the company. And Bradley, though surely disappointed, has HP’s developing webOS-based device business in which to take solace. That said, if there is a flight risk among these three, he seems the most likely. Jokingly introduced as the CEO of HP at the TechCrunch Disrupt conference earlier this week, Bradley quipped, “Not yet.” And it seems clear he had his eye on the job. But will losing it to Apotheker inspire him to hop trains? Tough to say. In any event, were he to threaten to leave, HP (HPQ) would surely do all that it could to keep him (maybe it already is). Losing him at this point would be terrible for the company’s consumer business.

Some problems the new iPod touch users may meet

1. How to change iTunes to recognize the new iPod touch
Some New iPod users may meet the situation that your iTunes can not detect your new iPod nano, iPod touch, or iPod Classic. It should recognize it immediately. If it doesn't, download the latest version of iTunes. The problem will be solved:
1) Re-launch iTunes, with and without your iPod plugged in.
2) With iTunes open, reset your iPod Touch
(here:http://docs.info.apple.com/article.html?artnum=305743 ) Press and hold the Sleep/Wake button and the Home button at the same time for at least ten seconds until the Apple logo appears.
3) Restart your computer leaving your iPod touch plugged in
Note: If you uninstall iTunes from a computer, it will be uninstalled for all the users. But it will show up again for all users once you re-install it again. Before uninstalling each user should backup his/her playlists so they can bring them back when the re-install is completed.No music for any of the users will be removed by iTunes. It will remain intact where it is saved.

2.'I can't turn on my iPod'
I have a 1st or 2nd generation video iPod (80 gig).
My computer is windows 2000 so I downloaded the windows 2000 iTunes. So I decided to update my iPod, it was updated and it was fine. It ran out of power. Then it won't turn on? I tried to charge it but it just keeps saying please wait such and such. I left it there for like 2 hours already, and still it didn't charge up... Is the problem because I updated my iPod or something else? And when I opened my computer, iTunes asked me if I can format my iPod into windows. I put yes, it didnt do anything.So I have to problems, its not charging.. and its not turning on.

I'd say just wait it out for a day or two, and if it's still having problems, take it in to your nearest Circuit City or something.”

by Kylla :'The one thing you never want to do with an iPod is let it run out of power, not good for it at all :P I've done it a few times but try to avoid it. What you want to do is hold the menu button and the play/pause button at the SAME time and just wait for it. It should restart it. Thats how my iPod works, yours could be different so experiment with the buttons. Try holding perhaps the center button and the play/pause button? or center button and the menu button? Try to see which two buttons will restart it, its bound to work. But hold BOTH of them down at the SAME time with one hand..and be patient, wait for about 10-15 seconds or so. :)”

3. Why does my 30G iPod video always die quickly?
Even when I am just listening to music. It shuts off after about 45 min. And that is a problem because I am going on a plane trip soon and I plan to watch a movie on my iPod, but movies eat your batttery. Does this happen to anyone else???? How can I make the battery life last longer. btw, it is only like a year old.

it doesnt depend on how old it is rather it depends on how many times you have charged and discharged it.
for increasing the battery life you should fully charge the battery every time you are charging it . and secondly you should never let it discharge completely . put it on charging just before it shows the red signal and disconnect it only when it is fully charged.
sorry to say but now u'll have to get the battery replaced from apple reseller if you want to watch complete movie the battery life as said by apple is 500 complete cycles of charging and discharging”

The problem is that your computer can't detect a completly dead iPod, but you need the computer to charge it so your screwed. j/k I solved it by pluging it into my ihome dock that plugs into the wall. So if you have a wall iPod dock or a car one you can charge it enough so that the computer can detect it. Problem solved.
